1. General

Schlüter-Systems KG takes the protection of your personal data and the legal obligations to ensure this protection very seriously. The relevant statutory requirements demand extensive transparency about the processing of personal data. Only if you as the data subject fully understand the processing can you be sufficiently informed about the meaning, purpose and scope of processing. Our data protection policy therefore explains in detail which so-called personal data we process when you use the website https://www.schlueter.de and all other websites referring to it (see Item 2. for definitions).

2.1. From the GDPR

This privacy policy uses the legal terms established in the GDPR. Further information about the definition of these terms (Art. 4, GDPR) can be found, e.g. at https://dejure.org/gesetze/DSGVO/4.html.

2.2. Cookies

Cookies are small units of information that are saved on your device or read from there by a website. Their purpose is to reuse this information at a later point. They contain letter and number combinations in order to recognise users and their settings, e.g. when they return to a cookie-setting website, to enable them to remain logged into a customer account, or to statistically analyse a certain user behaviour.

3. General information about data processing

We will only process personal data to the extent permissible by law. We will exclusively disclose personal data in the cases described below (see Item 4).

Personal data will be deleted or protected with technical and organizational measures (e.g. pseudonymisation, encryption) as soon as the purpose of processing no longer applies. This also applies in cases when a required retention period expires, unless it is necessary to keep saving the personal data for concluding a contract or fulfilling contractual obligations.

Unless longer storage or disclosure to third parties (in particular law enforcement authorities) is a legal obligation for us, the decision as to which personal data we collect, how long they are stored, and to which extent you have to disclose them depends on the features of our website you use in individual cases.

4. Data processing associated with using our website

The use of our website and its functions requires the regular processing of certain personal data.

4.1. Use of our website for information

When you open our website and use it for purely informational purposes, i.e. without the use of additional features such as the contact form or social media plug-ins, we will automatically collect personal data. This includes the following information: IP address of your device, as well as date and time of accessing the website. To guarantee the security of our information technology systems, we require a part of the IP address. This is also our legitimate interest, which is the reason why processing is permissible pursuant to Art. 6 (1), lit. f, GDPR. However, we will anonymise your IP address immediately after collecting it by deleting the last three digits of the IP address. After that, it is no longer possible to allocate the IP address to you.

4.2. Google web fonts

When you access our website, so-called web fonts are downloaded for the uniform display of fonts. This content is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). When you open our website, your browser downloads the required web fonts to its browser cache to correctly display texts and fonts. For this purpose, your browser must connect to the servers of Google. In this manner, Google learns that our website was accessed via your IP address.

The purpose of using Google web fonts is to ensure the uniform and appealing display of our website. This represents a legitimate interest in the definition of Art. 6 (1), lit. f, GDPR. The data transmission to the United States occurs in accordance with the Commission Implementing Decision (EU) 2016/1250 (EU-U.S. Privacy Shield).

We record your IP address to enable the transmission to Google. If your browser does not support web fonts or you deactivate this function, no data transmission will take place.

4.3. Google Maps

Parts of our website use functions of Google Maps to integrate map data. This content is provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland ("Google"). It allows for the display of interactive maps directly within the website and enables the use of the map function. When you open a sub-page of our website, in which Google Maps is used, your browser will download the associated code from Google. For this purpose, your browser must connect to the servers of Google. In this manner, Google learns that our website was accessed via your IP address. 4.10. Search engine and analytical utility: Cludo

Our website uses the utilities of the search engine "Cludo," provided by Cludo, Bremerholm 4, 1069 Copenhagen K, Denmark ("Cludo"). Cludo enables an effective prioritisation of the most relevant content in the search results and accordingly, controls the entries in the search screen. When you enter a search term into the search field, a connection is established to the servers of Cludo. Cludo will receive your IP address and search inquiry.

We use Cludo for the purpose of search result optimisation and the need-based design of our website. These purposes represent a legitimate interest in the definition of Art. 6 (1), lit. f, GDPR.

4.11. Functions: Contact form/e-mail contact

When you use the contact form on our website or send us an e-mail, we will process the personal data included in your message. The processing of this personal data is necessary for responding to your inquiry. In addition, your IP address and the date and time of your contact message will be saved when you send us an e-mail.

The purpose of this data processing is to respond to your inquiry, prevent any misuse of the contact form and guarantee the security of our information technology systems.

These forms of processing are legitimate because responding to your inquiry and protecting our IT systems represents legitimate interests in the definition of Art. 6 (1), lit. f, GDPR.

Your personal data will be saved as long as necessary for responding to your inquiry. If your inquiry should lead to to a contractual relationship at a later time, the data will be saved as long as necessary for carrying out pre-contractual measures or for contract performance. After that, personal data is routinely deleted. We will not combine this personal data with other data sources. We will not share data with third parties. We do not intend to transmit data to a third country or to an international organization. Although you are not obligated to share this personal data, using the contact form or sending an e-mail is not feasible without sharing such data.

4.12. Function: Seminar registration

You can register for our seminars held at Schlüter-Workbox through our website. When you do so, the personal data you share in your request will be transmitted to us via your browser and saved in our information technology systems. If you already are a customer, it is sufficient to indicate your customer number and your e-mail address; the remaining personal data will be taken from your customer account. We will also save your IP address and the time of your request.

The processing of the personal data you specify serves the purpose of preparing and carrying out the seminar, in which you want to participate. This processing is legitimate because you have given your consent pursuant to Art. 6 (1), lit. a, GDPR, which is required for contract performance pursuant to ARt. 6 (1), lit b, GDPR. The purpose of saving your IP address and time of registration is to guarantee the security of our information technology systems. This is also our legitimate interest, which is the reason why processing is permissible pursuant to Art. 6 (1), lit. f, GDPR.

We will save the personal data you have shared until after the performance of the seminar. We will not combine this personal data with other data sources. We will only share this data with third parties for the performance of the seminar (e.g. booking a hotel room at the request of the seminar participant). We do not intend to transmit data to a third country or to an international organization. You are not obligated to share this personal data, but sending promotional material or compiling an offer is not possible without such data.

4.13. Functions: Request of promotional materials or price offers

You can request individual offers for our products in our website or request promotional materials. When you do so, the personal data you share in your request will be transmitted to us via your browser and saved in our information technology systems. If you already are a customer, it is sufficient to indicate your customer number and your e-mail address; the remaining personal data will be taken from your customer account. We will also save your IP address and the time of your request.

The processing of the personal data you specify serves the purpose of creating and sending out an individual offer or promotional material. This processing is legitimate because it is required for the performance of pre-contractual measures pursuant to Art. 6 (1), lit. b, GDPR, and responding to your inquiry is a legitimate interest for us pursuant to Art. 6 (1), lit. f, GDPR. The purpose of saving your IP address and the time of your request is to guarantee the security of our information technology systems. This is also our legitimate interest, which is the reason why processing is permissible pursuant to Art. 6 (1), lit. f, GDPR.

We will save the data you have shared as long as necessary for sending promotional materials or compiling an offer, or, if we enter into a contractual relationship with you, as long as necessary for contract performance. After that, the data is routinely deleted. We will not combine this personal data with other data sources. We will only share data to the extent this is required for contract performance (e.g. with a shipping company). We do not intend to transmit data to a third country or to an international organization. You are not obligated to share this personal data, but sending promotional material or compiling an offer is not possible without such data.

4.14. Functions: Newsletter

You can subscribe to a newsletter in our website to receive information about product news and special offers. When you do so, the personal data you share in your registration will be transmitted to us via your browser and saved in our information technology systems. We will also save your IP address and the time of your registration.

The processing of the personal data you enter serves the purpose of personalising and distributing the newsletter. This processing is legitimate because you have given your consent pursuant to Art. 6 (1), lit. a, GDPR, in which we also have a legitimate interest in the definition of Art. 6 (1), lit. f, GDPR. We will save the personal data you entered until you terminate your subscription with us. We will not combine this personal data with other data sources. We will not share data with third parties. You are not obligated to provide personal data, but subscribing to our newsletter is not feasible without sharing this data.

4.15. Event registration

You have the option to register for events listed on our website. When you do so, the personal data you share in your registration will be transmitted to us via your browser and saved in our information technology systems. We will also save your IP address and the time of your registration.

The processing of the personal data you specify serves the purpose of preparing and carrying out the event, in which you want to participate. This processing is legitimate because it is required for contract performance pursuant to Art. 6 (1), lit. b, GDPR. The purpose of saving your IP address and time of registration is to guarantee the security of our information technology systems. This is also our legitimate interest, which is the reason why processing is permissible pursuant to Art. 6 (1), lit. f, GDPR.

We will save the personal data you have shared until after the performance of the event. We will not combine this personal data with other data sources. We will only share data to the extent this is required for event performance (e.g. with a cooperation partner who provides the event premises). We do not intend to transmit data to a third country or to an international organization. You are not obligated to provide personal data, but seminar registration is not feasible without sharing this data.

4.16. Participation in sweepstakes

You have the option to participate in sweepstakes we organise. We collect personal data (such as last name, first name, e-mail address) to enable your participation in the sweepstakes and, if applicable, to notify you as a winner. If the sweepstakes are organised via our website, we will also save your IP address and the time of your participation.

The processing of the personal data you specify serves the purpose of preparing and carrying out the sweepstakes, in which you want to participate. This processing is legitimate because it is required for contract performance pursuant to Art. 6 (1), lit. b, GDPR. The purpose of saving your IP address and time of participation is to guarantee the security of our information technology systems. This is also our legitimate interest, which is the reason why processing is permissible pursuant to Art. 6 (1), lit. f, GDPR.

As a rule, we will not share your data with third parties, unless doing so is required for the performance of the sweepstakes or sending out prizes (e.g. for mailing your prize). After the end of the sweepstakes, we will delete your data processed in the scope of the sweepstakes, unless you have consented to further processing (e.g. newsletter subscription). You are not obligated to provide personal data, but participation in sweepstakes is not feasible without sharing this data.

4.17. Application

You have the option to send us an application to the e-mail address specified on the website at www.schlueter.de/stellenangebote or at www.azubis.schlueter.de/bewerbungen or by regular mail. We will collect and process your personal data as part of your application for the purpose of reviewing your application. We will only save the application data you share with us (in particular, master data, communication data to the extent communicated to us as well as school certificates, additional qualifications, CV, desired salary, earliest possible starting date, and, if applicable, messages and content of documents you upload). This information will be forwarded to us when you send us an e-mail or submit your application by regular mail. We will also save your IP address and the time of your application.

The legal basis for the application process is Art. 88 (1), GDPR in conjunction with Sec. 26 (1), sentence 1, Federal Data Protection Act (BDSG). We will not share your data with third parties, unless you have given your explicit consent pursuant to Sec. 26 (2), BDSG (e.g. forwarding to other companies of the Schlüter Group). The purpose of saving your IP address and time of application is to guarantee the security of our information technology systems. This is also our legitimate interest, which is the reason why processing is permissible pursuant to Art. 6 (1), lit. f, GDPR.

We will save your data until the application process has been completed. The data associated with unsuccessful applications will be deleted after six months at the latest. We will save your data for up to two years with your explicit consent (e.g. to be added to a talent pool); after that time, data associated with unsuccessful applications will be deleted. This will also apply if you revoke your consent. We will not transmit your personal data to a third country or to an international organization.

You are not obligated to provide personal data, but your application cannot be processed without sharing this data.

5. Rights of data subjects

As the data subject, you have the right to information pursuant to Art. 15, GDPR, the right to rectification pursuant to Art. 16, GDPR, the right to erasure pursuant to Art. 17, GDPR, the right to restriction of processing pursuant to Art. 18, GDPR, as well as the right to data portability pursuant to Art. 20, GDPR. The right to information and the right to erasure are subject to the restrictions from Sections 34, 35, BDSG. Furthermore, you have a right to lodge a complaint with a supervisory authority (Art. 77, GDPR in conjunction with Section 19, BDSG).

6. Automated decisions in individual cases, including profiling

There will be no automated decisions in individual cases, including profiling.

7. Controller's notification duties

We will notify all recipients to whom we disclose your personal data of any rectification or erasure of your personal data or restriction of processing pursuant to Art. 16, Art 17 (1), and Art. 18, GDPR, unless such notification is impossible or associated with a disproportional effort.

We will notify you of recipients at your request.

8. Right to object

You have the right to object on grounds relating from your particular situation to the processing of your personal data that is based on Art. 6 (1), lit e or f, GDPR. Where personal data are processed for direct marketing purposes, you have the right to object at any time to the processing of your personal data for such marketing. 9. Right to withdraw consent for processing of personal data

You have the right to withdraw your consent at any time pursuant to Art. 7 (3), sentence 4, GDPR. This will not affect the lawfulness of processing based on content before this withdrawal. Accordingly, withdrawal only applies to processing planned for the time after the withdrawal. Withdrawal of consent can be communicated informally via regular mail or e-mail. Following your objection, we will no longer process your personal data, unless this is permitted by another (legal) basis. However, if you object and there is no other legal ground for processing, personal data must be erased without undue delay pursuant to Art. 17 (2), lit b, GDPR at your request.
